We understand that the costs of engaging a lawyer can be an obstacle for many people in seeking advice. That’s why we offer a free initial consultation, so that you can get quality advice regarding the most important issues affecting you, and make an informed decision about the next steps.

There is no requirement to obtain legal advice following a separation and prior to filing an application for divorce in Australia, and the decision of whether to engage a lawyer depends on your individual circumstances and the nature of your separation.

However, if you’re considering separation or have already separated, it is always sensible to at least speak with a lawyer so that you understand how the law applies to your circumstances, and make an informed decision about how best to proceed.

If your circumstances are straightforward, and if you and your former partner have reached an agreement regarding most or all issues, you may not need to formally engage a lawyer, and you might be able to complete any necessary paperwork yourself. In that case, we will usually encourage you to lodge your own application for divorce to help reduce your legal costs. We are also able to review an application you have drafted yourself and let you know if there are any issues that need to be addressed prior to lodgement.

If your circumstances are more complex, then having a lawyer to help guide you through the process of separation can make all the difference. At Borda Family Lawyers, we can manage the whole process and make sure that all relevant issues are properly addressed with care, experience and attention to detail.

Under Australian law, you and your partner must be separated for at least 12 months before you can apply for a divorce. There are other requirements you must satisfy before filing for divorce, which you can read about here [link to divorce page.]

Once you have lodged your application for divorce with the Court, it generally takes around two to three months to receive the formal Divorce Order. This period includes the time it takes for the application to be served on your former spouse, the time for the court to review your application, and make the final Divorce Order.

It’s important to remember that divorce is a separate process from parenting, property and child support issues that may arise following a separation. Unlike divorce, there is no minimum separation period to start addressing those issues, and negotiations, or in urgent cases, court proceedings can begin immediately following separation. If you and your partner can reach agreement in relation to some or all of those issues, then they can be finalised prior to a divorce order being made.

If you are unable to agree in relation to those issues and it becomes necessary to commence court proceedings, then the court process can take anywhere from 12 to 24 months (and in some cases, even longer.)

The terms divorce lawyer and family lawyer can be used interchangeably, but it’s important to be aware that there is a significant difference between divorce proceedings, which can be quite straightforward, and family law proceedings, which can include parenting, property settlement, child support, and maintenance issues, and be much more complex.

A divorce lawyer can help with applying for a divorce; but most divorces involve wider family law issues that are more complicated and require specialist knowledge.
